These terms are agreed between, on one hand, Barbara Berrada EI, trading as LES ZIGOUIS, registered with the Chamber of Commerce of Rouen as well as with the Maison des Artistes under the registration number…

And on the other hand, individuals wishing to make a purchase via the LES ZIGOUIS website (www.zigouis.com), hereinafter referred to as "the User".

These conditions only concern non-trading individuals. The parties agree that their relations will be governed exclusively by this contract, to the exclusion of any condition previously available on the site. If a condition were to be lacking, it would be considered to be governed by the practices prevailing in the sector of distance selling of companies headquartered in France.

1-These conditions aim to define the terms of sale between Barbara Berrada and the User, from ordering to services, including payment and delivery. They regulate all the necessary steps for placing an order and ensure the follow-up of this order between the contracting parties.

 

2-Any order implies acceptance of the prices and description of the products available for sale as well as the general conditions of sale. Any dispute on this point will be dealt with in the context of a possible exchange and the guarantees mentioned below.

LES ZIGOUIS undertakes to honor orders received on the website within the limits of available product stocks. In case of unavailability, Barbara Berrada undertakes to inform the User and offer him a similar product, or a refund if he wishes.

 

3-Shipping and delivery costs

Shipping costs are borne by the User and depend on the delivery country. They will be specified to the customer when confirming the order.

The ordered products will be delivered to the address indicated by the User.

Orders placed may take up to 10 days to be shipped, if they need to be manufactured, this period may be longer, we will notify you.

Delivery times run from the date of dispatch. They therefore depend on the company that dispatches, this period is often 48 to 72 hours for France, and at least 4 working days for Europe. Delivery times are given as an indication by our transport providers and may also vary depending on the time of year.

For deliveries outside the European Union, we strive to facilitate customs clearance with our delivery provider. In some cases, the delivery time may be extended due to customs checks, independently of our will.

If the customer has chosen a "signature required" delivery method, in case of absence, a notice of delivery must be left in the recipient's mailbox. The customer then has 15 days to collect it from his post office.

At any time, you have the possibility to track your package on the Chronopost website, La Poste.

In case of delay, Barbara Berrada's liability cannot be engaged for any reason whatsoever. Consequently, no compensation claim of any kind may be claimed by the User.

 

4-Prices are indicated in euros all taxes included, except for countries outside the European Union. These prices are excluding participation in processing costs (shipping, packaging, and packaging of the package).

The final price charged to the customer is the price indicated on the order confirmation.

Payment is made by credit card bearing the Visa, Eurocard, Mastercard, or American Express logo. You can also pay via PayPal, as well as by bank transfer or check. If you opt for online payment, your bank account will be debited upon validation of your order, knowing that there is always a delay on the part of the banks, the payment validation often takes a day from the validation of the order.

5- All the items in our current collections and not discounted can be exchanged (depending on the stock) or refunded. Discounted or end-of-series items cannot be refunded or returned.

For France, returns are at the customer's expense and will only be made via Colissimo. This within fourteen working days from the date of receipt or withdrawal of the package. Customer returns will be made by post to the address indicated below

The exercise of the right of withdrawal must be done by email to zigouis@free.fr within the time limit. The Customer cannot exercise his right of withdrawal for a product made to measure, used, worn, washed, damaged, or unsealed.

It is the responsibility of the User to keep any proof and date of this return. If it is an exchange, the new delivery costs will not be invoiced to the customer. Refunds will be made within 10 working days following receipt of the package.

All items on this site being handmade, in an artisanal way, they cannot be absolutely identical. The customer accepts this data.

 

6-Warranties and disputes

All items are subject to a contractual warranty, which does not preclude the legal warranty provided for in articles 1641 et seq. of the Civil Code. The user also benefits from a warranty allowing him to return defective delivered items in accordance with articles L 211-4 et seq. of the Consumer Code.

It is the responsibility of the customer to refer to these texts if he wishes to have more details.

All disputes concerning a sale concluded under the general terms and conditions of sale could - concerning their validity, their interpretation, their performance, their termination, their consequences, their follow-up and which could not have been resolved between the seller and the customer - be submitted to the competent courts in the conditions of common law.

In the event of a dispute, the Customer is informed that he can resort to conventional mediation to find an amicable solution before any legal action, in particular with the Consumer Mediation Commission (C. consom. art. L 612-1) or with existing sectoral mediation bodies www.cm2c.net .

Claims: Upon receipt of the items, the customer must immediately check the condition and conformity of the items with the order, in particular the quality and quantity of the items and their characteristics. If the items do not comply with the order or are damaged, the customer must make reservations and claims to the carrier or refuse delivery if the package is open or damaged, and send his claims by email to zigouis@free.fr within 7 (seven) days following delivery. The customer must then specify and justify in detail the reasons for the claim. No claim will be taken into account if the use of the items is considered disproportionate. No spontaneous return, without Barbara's agreement, will be accepted, except in the case of exercising the right of withdrawal.

Except as provided in these T&C, items sold are neither returned nor exchanged.

The items sold are covered by the legal guarantee of conformity provided for in Articles L. 217-4 to L. 217-13 of the Consumer Code and by the guarantee relating to defects in the thing sold, under the conditions provided for in Articles 1641 to 1648 and 2232 of the Civil Code. In accordance with the provisions of Article L. 217-15 of the Consumer Code, Articles L. 217-4, L. 217-5, and L. 217-12 of the Consumer Code as well as Article 1641 and the first paragraph of Article 1648 of the Civil Code.

 

7-Signature and Proof

In all cases, the online provision of the credit card number and the final validation of the order will constitute proof of the entirety of the said order in accordance with the provisions of the law of March 13, 2000, and will make the sums entered by the seizure of the articles on the order form due.

This validation constitutes a signature and express acceptance of all operations carried out on the site. However, in the event of fraudulent use of his credit card, the customer is invited, as soon as this use is noted, to contact LES ZIGOUIS by sending an email to zigouis@free.fr.

I undertake to describe with the greatest accuracy the products sold on the website. However, the responsibility of SOEUR could not be engaged if the non-performance of its obligations is attributable either to the unforeseeable and insurmountable fact of a third party to the contract or to a case of force majeure as defined by French jurisprudence. Similarly, the responsibility of Barbara Berrada cannot be engaged for all the inconveniences or damages inherent in the use of the Internet network, in particular a service interruption, an external intrusion, or the presence of computer viruses.

All elements of the website www.zigouis.com, whether visual or written, whether photographs, graphics, or any other creations, including underlying technology, are protected by copyright, trademarks, or patents.

In the event that any provision of this contract is declared null and void due to a change in legislation, regulations, or a court decision, this shall in no way affect the validity and compliance of the present terms and conditions of sale.

These terms and conditions apply for the entire duration of the services offered by Barbara Berrada.

Order forms and invoices are archived on a reliable and durable medium in order to correspond to a faithful and durable copy in accordance with Article 1348 of the Civil Code.

These terms and conditions are subject to French law. The competent court in the event of a dispute shall be that of the defendant's place of residence or, at the choice of the plaintiff, the place of effective delivery of the product.
